Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Skyweb Communication Services Pvt Ltd ("Skyweb", "we", "our", or "us"), a company registered in Kenya and based in Eldoret, Uasin Gishu County.

By downloading, installing, accessing, or using any Skyweb application, platform, or service โ€” including but not limited to the Table of Deception (TOD) app, Feed My Sheep (FMS), Skyweb Family Tree (SFT), the ICT Learners platform, or the Skyweb corporate website โ€” you agree to be bound by these Terms.

โš ๏ธ If you do not agree with any part of these Terms, you must not use our services. Continued use of any Skyweb service after changes to these Terms constitutes your acceptance of the updated Terms.

These Terms should be read together with our Privacy Policy, which is incorporated into these Terms by reference.

Section 03

User Accounts

Registration

Some Skyweb services require you to create an account using Firebase Authentication. When registering you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify Skyweb immediately of any unauthorised account use at info@skywebcom.co.ke
  • Not share your account credentials with others

Account Eligibility

  • TOD, FMS, and SFT accounts are for users aged 13 and above
  • Users under 18 must have parental or guardian consent
  • ICT Learners accounts for minors are managed by the institution โ€” see Section 12
  • One account per person; duplicate accounts may be removed

Account Deletion

You may delete your account at any time by emailing info@skywebcom.co.ke. Upon deletion, your personal data will be purged within 30 days in accordance with our Privacy Policy.

Section 04

Acceptable Use Policy

You agree to use Skyweb services only for lawful purposes and in a manner consistent with these Terms. You must NOT:

  • Use our services for any illegal purpose or in violation of any Kenyan or applicable law
  • Attempt to gain unauthorised access to any Skyweb system, account, or database
  • Reverse engineer, decompile, or disassemble any Skyweb application or software
  • Upload or transmit viruses, malware, or any malicious code
  • Use automated scripts, bots, or scrapers on any Skyweb platform
  • Harass, abuse, or harm other users of our platforms
  • Impersonate Skyweb, its employees, or other users
  • Use our services to send spam or unsolicited commercial communications
  • Copy, reproduce, or distribute Skyweb app content without written permission
  • Use our family tree data of other users for commercial or harmful purposes
  • Attempt to circumvent subscription or payment controls

โš ๏ธ Violation of this Acceptable Use Policy may result in immediate account suspension or termination without notice, and may be reported to relevant authorities.

Section 05

User Content

Certain Skyweb services allow you to submit content including family member profiles, photographs, names, dates, and other personal information ("User Content"). Regarding User Content:

  • You retain full ownership of all User Content you submit to Skyweb platforms
  • You grant Skyweb a limited licence to store, process, and display your content solely to provide the service to you
  • You are solely responsible for the accuracy and legality of your User Content
  • You confirm you have the right to upload photos and information about family members you add
  • Skyweb does not claim ownership of your family data or photos
  • You must not upload content that is defamatory, obscene, or violates the rights of others

๐Ÿ“ธ For SFT specifically โ€” when you add a family member's details and photo, you are confirming you have permission from that person (or their guardian) to include them in your family tree.

Section 06

Intellectual Property

All Skyweb applications, software, code, designs, content, branding, logos, devotional materials, curriculum content, and publications are the exclusive intellectual property of Skyweb Communication Services Pvt Ltd and are protected under applicable Kenyan and international intellectual property laws.

  • You may not copy, reproduce, modify, or distribute Skyweb software or content without written permission
  • The name "Skyweb", "Skyweb Family Tree", "Table of Deception", "Feed My Sheep", and associated logos are Skyweb trademarks
  • The devotional content in TOD is authored by Paul Njuri Muthui and is protected by copyright
  • The FMS 252-lesson curriculum is original Skyweb content โ€” not for redistribution
  • The Skyweb globe logo and branding are proprietary and may not be used without permission

Requests for permission to use Skyweb intellectual property should be directed to info@skywebcom.co.ke.

Section 07

Subscriptions & Payments

Free Services

TOD and FMS are currently available free of charge. Skyweb reserves the right to introduce premium features in the future with advance notice to users.

SFT Subscription Plans

Skyweb Family Tree operates on a subscription model with the following terms:

  • Subscriptions are billed monthly in advance
  • Payment is processed through our authorised payment partners
  • Subscription fees are stated in Kenyan Shillings (KES) on the pricing page
  • Prices are subject to change with 30 days written notice to subscribers
  • Failure to pay will result in service suspension after a 7-day grace period

Refund Policy

  • Requests for refunds within 7 days of initial subscription payment will be considered
  • Refunds are not available for partial subscription months
  • Refund requests must be submitted to info@skywebcom.co.ke with your account details
  • Skyweb reserves the right to approve or decline refund requests at its discretion

Cancellation

  • You may cancel your subscription at any time via email to info@skywebcom.co.ke
  • Cancellation takes effect at the end of the current billing period
  • Your tree data is retained for 30 days post-cancellation before permanent deletion
Section 08

Skyweb Family Tree โ€” Specific Terms

These additional terms apply specifically to users of the Skyweb Family Tree (SFT) platform.

Tree Ownership

  • The person who creates a tree is the Tree Owner and has full admin control
  • Tree Owners are responsible for managing member access and permissions
  • Tree Owners are responsible for the accuracy of data added to their tree
  • Ownership cannot be transferred without contacting Skyweb support

Tree IDs

  • Each tree is assigned a unique Tree ID in the format SKY-YYYY-NNNN
  • Tree IDs are permanent and cannot be changed after assignment
  • Tree IDs are used for support reference only โ€” they do not make your tree public

Family Data Responsibility

  • You are responsible for obtaining consent of living adults before adding them to your tree
  • You must not add false, defamatory, or harmful information about any person
  • Skyweb is not liable for disputes arising from family data entered by users
  • We reserve the right to remove content that violates these Terms upon valid complaint

Inbreeding Detection

SFT's inbreeding detection feature is provided as a helpful tool only. It is not a substitute for professional genealogical or medical advice. Skyweb accepts no liability for decisions made based on this feature.

Section 09

Disclaimers & Warranties

Skyweb services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Uninterrupted or error-free operation of any service
  • Accuracy or completeness of any content within our apps
  • That our services will meet your specific requirements

Devotional Content Disclaimer

The TOD and FMS apps contain Christian devotional and discipleship content based on personal testimony and Scripture study. This content is for spiritual growth purposes only and does not constitute professional counselling, medical, psychological, or legal advice.

Service Availability

Skyweb does not guarantee 100% uptime. Services may be temporarily unavailable due to maintenance, Firebase/Google infrastructure issues, or events beyond our control. We will communicate planned downtime where possible.

Section 10

Limitation of Liability

To the fullest extent permitted by Kenyan law, Skyweb Communication Services Pvt Ltd shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, family records, or information due to technical failure
  • Unauthorised access to your account or data by third parties
  • Any decisions made based on app content, devotional material, or family tree data
  • Damages arising from third-party services (Firebase, YouTube, FormSubmit, etc.)
  • Loss of income or business arising from service interruption

Our total liability to you for any claim arising from these Terms shall not exceed the total amount you have paid to Skyweb in the three months preceding the claim, or KES 1,000, whichever is greater.

๐Ÿ’พ We strongly recommend that SFT users regularly export or backup their family tree data. While we protect your data, Skyweb is not liable for data loss due to circumstances beyond our reasonable control.

Section 11

Termination

Termination by You

You may stop using any Skyweb service at any time and request account deletion by emailing info@skywebcom.co.ke. Your data will be deleted within 30 days of the request.

Termination by Skyweb

Skyweb reserves the right to suspend or terminate your account immediately and without prior notice if you:

  • Violate any provision of these Terms or our Acceptable Use Policy
  • Provide false registration information
  • Engage in fraudulent, abusive, or harmful behaviour on our platforms
  • Fail to pay subscription fees after the grace period
  • Act in a way that endangers other users or compromises platform security

Effect of Termination

  • Upon termination your access to all Skyweb services is revoked immediately
  • Data associated with terminated accounts is deleted within 30 days
  • Sections 6 (Intellectual Property), 9 (Disclaimers), and 10 (Liability) survive termination
Section 12

Minors & ICT Learners Platform

TOD, FMS & SFT

These services are intended for users aged 13 and above. Users between 13 and 17 must have parental or guardian consent to create an account. By registering, a minor's parent or guardian confirms their consent.

ICT Learners Platform

The ICT Learners Platform is designed for students aged 6โ€“14 in supervised educational settings. The following terms apply specifically to this platform:

  • Student accounts are created and managed by the school or educational institution
  • Schools and institutions are responsible for obtaining parental consent for student participation
  • Students do not directly submit personal data to Skyweb โ€” data is managed institutionally
  • Parents or guardians may contact info@skywebcom.co.ke to enquire about their child's data
  • All content on the ICT platform is age-appropriate, safe, and curriculum-aligned
  • No advertising, profiling, or commercial activity is directed at minors on this platform
Section 13

Governing Law & Disputes

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of Skyweb services shall be resolved as follows:

  • Step 1 โ€” Informal Resolution: Contact us at info@skywebcom.co.ke. We aim to resolve disputes amicably within 14 days
  • Step 2 โ€” Mediation: If informal resolution fails, parties agree to attempt mediation before pursuing legal action
  • Step 3 โ€” Legal Action: Unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Kenya

Nothing in these Terms limits your rights as a consumer under Kenyan consumer protection law or the Data Protection Act, 2019.

Section 14

Changes to These Terms

Skyweb reserves the right to update or modify these Terms of Service at any time. When we make material changes we will:

  • Update the "Last Updated" date at the top of this page
  • Notify TOD and FMS users via in-app notification upon next login
  • Notify SFT subscribers via email to their registered address
  • Post the updated Terms at skywebcom.co.ke/terms.html

Your continued use of any Skyweb service after updated Terms are posted constitutes your acceptance of those Terms. If you do not agree to updated Terms, you must stop using our services and may request account deletion.
